All but six of 16 or 17 passengers were injured in some way when a bus struck a tree near Broadmeadows township on December 1, a policeman told Broadmeadows Court to day.
The tree which was 9 ft. from the side of the road, was partly torn down, the policeman. First Constable J. C. O’Toole. said.
James Roberts, of Park Street. Abbotsford. motor driver, has been charged with having driven while under the influence of liquor, and with having driven negligently.
He pleaded not guilty.
Nurse Claire Mary Maguire of Greenvale Sanatorium, said the bus was on its incorrect side for a part of the journey.
Before striking the tree it “broadsided” around a corner.
Constable O’Toole said Roberts was in the driver’s seat.
As he walked down the steps he swayed. “I finconsidered him under the influence of liquor.” he continued.
